Website Terms and Conditions for Roam Aus Magazine

1. Introduction and Acceptance of Terms

Welcome to www.roamaus.com (the "Website"), owned and operated by Roam Manor Pty Ltd (ABN 57 648 495 407), trading as Roam Aus Magazine.

Upon using this Website, you hereby indicate your acknowledgement and agreement to abide by the terms and conditions of use outlined herein (the "Terms"). In the context of these Terms, "Us," "Our," and "We" refer to Roam Manor Pty Ltd / Roam Aus Magazine, and "You" and "Your" refer to you as the client, visitor, website user, or subscriber.

If you do not agree with these Terms, you must cease usage of the Website immediately. We reserve the right to review and change any of the Terms by updating this page at our sole discretion. Any changes to the Terms take immediate effect from the date of their publication.

 

2. User Accounts and Subscriptions ("Roam Subs")

(a) Account Creation: To access our digital magazine and other member benefits, you must register for an account and become a subscriber ("Roam Sub").

(b) Eligibility: You must be at least 18 years of age to create an account and subscribe to our services. You warrant that any information you provide during the registration process is accurate, correct, and up to date.

(c) Account Responsibilities: You are responsible for maintaining the confidentiality of your account password. You are solely responsible for all activities that occur under your account. We do not store or have access to your password.

(d) Subscription Payments: Subscriptions are offered on a recurring monthly ("Roam Aus Explorer") or annual ("Roam Aus Legend") basis, as selected by you at the time of purchase. Payments are processed via our third-party payment processor, Stripe, and may be made by Card, Apple Pay, or Google Pay. By subscribing, you authorise us to charge your chosen payment method on a recurring basis.

(e) Cancellation: You may cancel your subscription at any time through your 'Roam Subs' member portal on our Website. The cancellation will take effect at the end of your current paid billing period.

(f) Termination by Us: We reserve the right to suspend or terminate your account and subscription without notice if you breach these Terms, including but not limited to failing to make a payment or engaging in prohibited conduct. Termination will result in the immediate revocation of access to all subscription content and forfeiture of eligibility for any ongoing competitions or promotions.

3. Product Sales, Delivery, and Refunds

(a) Merchandise: We offer merchandise, such as water bottles, for sale on our Website.

(b) Delivery Policy: Merchandise is shipped from Airlie Beach, Queensland, via Aramex or another designated carrier. We are responsible for the product until it is delivered to the address you provide. Risk in the products passes to you upon delivery. Please inspect all goods upon arrival.

(c) Refund Policy:
Digital Magazine Subscriptions: All payments for digital magazine subscriptions are final and non-refundable.
Merchandise: If you are not satisfied with your merchandise due to issues with quality or if it was damaged in transit, you may return it for a refund within 20 days from the date of delivery. To initiate a return, please contact us at info@roamaus.com. Returned items must be in their original condition.

4. User-Generated Content (UGC)

(a) Submissions: We may engage certain users, contributors, or partners ("Feature Partners") to provide content for our magazine and promotional channels. This content may include photos, videos, articles, stories, and quotes ("UGC").

(b) License to Use UGC: By providing UGC to us, you grant Roam Manor Pty Ltd a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, modify, adapt, edit, publish, translate, and distribute the UGC in any existing or future media, including our Website, social media channels, and marketing materials. You also grant us the right to use your name or brand name in connection with the UGC for attribution purposes.

(c) Your Warranties: You warrant and represent that:
You are the sole owner of the UGC and/or have obtained all necessary rights, licenses, and permissions to grant us the rights described herein.
The UGC does not infringe upon the copyright, trademark, privacy, or any other intellectual property rights of any third party.
You agree to indemnify us against any claims, damages, or losses arising from a breach of these warranties.

5. 'Roam Aus Rangers' Affiliate Program

(a) Participation: We may, at our sole discretion, invite certain individuals to participate in our 'Roam Aus Rangers' affiliate program ("Rangers"). Participation is by invitation only.

(b) Referral Fee: Rangers will be provided with a unique referral code. For each new, paying subscriber that signs up using your code, you will receive a referral fee at the rate agreed upon in writing at the commencement of your participation in the program. This fee is payable only for legitimate, verified, and paying subscribers.

(c) Code Usage: Your referral code is intended for sharing on your personal channels (e.g., your own social media, blog, or website). You are not permitted to share your code on public coupon or discount websites.

(d) Program Terms: We reserve the right to modify the terms of the Ranger program, or to cancel your participation and your referral code, at any time, for any reason, without notice or liability. There are no guaranteed earnings.

6. Monthly Giveaways and Competition Entry Allocation

Eligibility for entry into any competitions, giveaways, or promotions ("Giveaways") is strictly limited to active, paid-up 'Roam Subs' subscribers. All prizes are non-transferable and cannot be exchanged for cash or any other alternative. To be eligible to receive a physical prize, the winner must provide a valid delivery address within Australia. Prizes will be delivered via our designated carrier and may require collection from a local post office or depot as per the carrier's standard procedures.

The allocation of entries is as follows:
(a) Entry Allocation:


Roam Aus Explorer (Monthly Subscription): You will receive ten (10) entries into the current monthly Giveaway for each successful monthly subscription payment.
Roam Aus Legend (Yearly Subscription): Upon a successful annual subscription payment, you will immediately receive one hundred and twenty (120) base entries plus twenty (20) bonus entries, for a total of one hundred and forty (140) entries.


(b) Subscription Status and Entry Management:


Active Subscription: While your subscription is active and in good financial standing, you will accumulate entries as described above and remain eligible for all Giveaways.
Cancelled, Paused, or In-Arrears Subscription: If your subscription is cancelled, paused, or your payment fails, your access to member content will cease, and your entire balance of entries will become 'Inactive'. You will not accumulate new entries or be eligible for Giveaways while your subscription status is Inactive.
Reactivation and Grace Period: You have a one (1) calendar month grace period from your subscription's lapse date to reactivate your account and retain your entry status.
Reactivation within the Grace Period: If you reactivate your subscription within this one-month period, your full 'Inactive' entry balance will be restored, and you will resume accumulating entries with your next successful payment.
Reactivation After the Grace Period: If you reactivate your subscription after the one-month grace period has expired, your previously 'Inactive' entry balance will be permanently halved. Your entry accumulation will then reset, starting from the new reactivation date.

7. Intellectual Property

All content, branding, and materials on this Website, including but not limited to text, graphics, logos, images, and software (the "Content"), are the property of Roam Manor Pty Ltd or its licensors and are protected by Australian and international copyright laws. Except for your personal, non-commercial use, you may not copy, reproduce, republish, or distribute any Content without our prior written permission.

8. Prohibited Conduct

You agree to use this Website only for lawful purposes. You must not:
Engage in any conduct that is unlawful, defamatory, harassing, or that may cause distress or inconvenience to any person.
Transmit or post obscene, offensive, or disruptive content.
Infringe upon the rights of any third party.
Knowingly transmit any viruses, trojans, or other malicious code to or through the Website.

We reserve the right to moderate all content and remove any user or subscriber who violates these rules.
